PROTOCOL ON THE ACCESSION OF THE PEOPLE'S REPUBLIC OF CHINA

 

  第16條 特定(ding)產品(pin)過渡性保障機(ji)制(zhi)

  16. Transitional Product-Specific Safeguard Mechanism

  1.如(ru)原(yuan)產(chan)(chan)于(yu)中(zhong)國(guo)的(de)(de)(de)產(chan)(chan)品在(zai)進口至任何(he)WTO成(cheng)員(yuan)領土(tu)時,其(qi)增長的(de)(de)(de)數量或所(suo)依(yi)據(ju)的(de)(de)(de)條件對生產(chan)(chan)同類產(chan)(chan)品或直接競爭(zheng)產(chan)(chan)品的(de)(de)(de)國(guo)內生產(chan)(chan)者造成(cheng)或威脅(xie)造成(cheng)市場擾(rao)亂,則受(shou)此影響的(de)(de)(de)WTO成(cheng)員(yuan)可請(qing)求(qiu)與中(zhong)國(guo)進行(xing)磋商,以期尋(xun)求(qiu)雙方滿意的(de)(de)(de)解決辦法,包括受(shou)影響的(de)(de)(de)成(cheng)員(yuan)是否應根據(ju)《保障措施(shi)協定》采(cai)取措施(shi)。

  1. In cases where products of Chinese origin are being imported into the territory of any WTO Member in such increased quantities or under such conditions as to cause or threaten to cause market disruption to the domestic producers of like or directly competitive products, the WTO Member so affected may request consultations with China with a view to seeking a mutually satisfactory solution, including whether the affected WTO Member should pursue application of a measure under the Agreement on Safeguards.

  任何(he)此種請求應立即通知保(bao)障措施委(wei)員會。

  Any such request shall be notified immediately to the Committee on Safeguards.

  2.如(ru)在這些(xie)雙邊磋商(shang)過程中(zhong),雙方同意原產(chan)于中(zhong)國的(de)進口產(chan)品是造成此(ci)種情況的(de)原因并有必要(yao)采取(qu)行動(dong),則中(zhong)國應采取(qu)行動(dong)以防止或(huo)補(bu)救(jiu)此(ci)種市場(chang)擾亂。任何此(ci)類行動(dong)應立即通知保障措施委員會。

  2. If, in the course of these bilateral consultations, it is agreed that imports of Chinese origin are such a cause and that action is necessary, China shall take such action as to prevent or remedy the market disruption. Any such action shall be notified immediately to the Committee on Safeguards.

  3.如磋(cuo)商(shang)(shang)未能使中國與有(you)關WTO成(cheng)員在收到磋(cuo)商(shang)(shang)請求后60天內(nei)達成(cheng)協議,則受(shou)影響的WTO成(cheng)員有(you)權(quan)在防(fang)止或補救此(ci)種市(shi)場擾亂(luan)所必需的限(xian)度內(nei),對此(ci)類產品撤銷減讓或限(xian)制進口。任何此(ci)類行動應(ying)立即通知保障措施委員會。

  3. If consultations do not lead to an agreement between China and the WTO Member concerned within 60 days of the receipt of a request for consultations, the WTO Member affected shall be free, in respect of such products, to withdraw concessions or otherwise to limit imports only to the extent necessary to prevent or remedy such market disruption. Any such action shall be notified immediately to the Committee on Safeguards.

  4. Market disruption shall exist whenever imports of an article, like or directly competitive with an article produced by the domestic industry, are increasing rapidly, either absolutely or relatively, so as to be a significant cause of material injury, or threat of material injury to the domestic industry.

  在認定(ding)是否存在市場擾亂時,受影(ying)響的(de)WTO成員(yuan)應考慮客(ke)觀因素,包括(kuo)進(jin)口(kou)量、進(jin)口(kou)產品對同(tong)類(lei)產品或直接競爭(zheng)產品價格的(de)影(ying)響以及此類(lei)進(jin)口(kou)產品對生產同(tong)類(lei)產品或直接競爭(zheng)產品的(de)國內(nei)產業的(de)影(ying)響。

  In determining if market disruption exists, the affected WTO Member shall consider objective factors, including the volume of imports, the effect of imports on prices for like or directly competitive articles, and the effect of such imports on the domestic industry producing like or directly competitive products.

  5.在根據第3款采(cai)取(qu)措(cuo)施(shi)之前,采(cai)取(qu)此(ci)項(xiang)行動(dong)的WTO成員(yuan)應向(xiang)所有利(li)害(hai)關系(xi)(xi)方提供合理(li)的公告,并應向(xiang)進口商、出口商及(ji)其他利(li)害(hai)關系(xi)(xi)方提供充分機會,供其就擬議措(cuo)施(shi)的適當性及(ji)是否符(fu)合公眾利(li)益提出意見和證據。

  5. Prior to application of a measure pursuant to paragraph 3, the WTO Member taking such action shall provide reasonable public notice to all interested parties and provide adequate opportunity for importers, exporters and other interested parties to submit their views and evidence on the appropriateness of the proposed measure and whether it would be in the public interest.

  該WTO成員應提供關于采取措施的(de)決定的(de)書面通知,包括采取該措施的(de)理(li)由及其(qi)范圍和期(qi)限(xian)。

  The WTO Member shall provide written notice of the decision to apply a measure, including the reasons for such measure and its scope and duration.

  6.一(yi)WTO成(cheng)員(yuan)只能在(zai)防(fang)止和(he)補救市場擾亂所必需的時限內根據本條采(cai)取措(cuo)施。

  6. A WTO Member shall apply a measure pursuant to this Section only for such period of time as may be necessary to prevent or remedy the market disruption.

  如(ru)一措施(shi)是由(you)于進口(kou)水平的(de)(de)(de)相對增長而采(cai)取的(de)(de)(de),而且如(ru)該(gai)項(xiang)措施(shi)持續有效(xiao)的(de)(de)(de)期限超過2年,則中(zhong)國(guo)有權針(zhen)對實施(shi)該(gai)措施(shi)的(de)(de)(de)WTO成員的(de)(de)(de)貿(mao)易暫停實施(shi)GATT1994項(xiang)下(xia)實質相當的(de)(de)(de)減讓或(huo)義務。

  If a measure is taken as a result of a relative increase in the level of imports, China has the right to suspend the application of substantially equivalent concessions or obligations under the GATT 1994 to the trade of the WTO Member applying the measure, if such measure remains in effect more than two years.

  但是(shi),如一措施(shi)是(shi)由于進口(kou)的絕(jue)對增長而采取的,而且(qie)如該(gai)措施(shi)持續有效的期限超過3年,則中國有權針對實(shi)施(shi)該(gai)措施(shi)的WTO成(cheng)員的貿易暫停實(shi)施(shi)GATT1994項下實(shi)質相當的減讓(rang)或義務(wu)。

  However, if a measure is taken as a result of an absolute increase in imports, China has a right to suspend the application of substantially equivalent concessions or obligations under the GATT 1994 to the trade of the WTO Member applying the measure, if such measure remains in effect more than three years.

  中國采(cai)取(qu)的任何此種(zhong)行(xing)動應立即通知保障措施委員(yuan)會。

  Any such action by China shall be notified immediately to the Committee on Safeguards.

  7.在遲延會造成(cheng)難以(yi)補救的(de)損害的(de)緊急情況下(xia),受影響的(de)WTO成(cheng)員可根據一項有關進口產(chan)品已經造成(cheng)或(huo)威脅造成(cheng)市(shi)場(chang)擾亂(luan)的(de)初步認定,采取臨時(shi)保(bao)障措施。

  7. In critical circumstances, where delay would cause damage which it would be difficult to repair, the WTO Member so affected may take a provisional safeguard measure pursuant to a preliminary determination that imports have caused or threatened to cause market disruption.

  在此種情況下,應(ying)在采(cai)取措施后立即向保障措施委員會(hui)作出有關所采(cai)取措施的通(tong)知,并(bing)提出進行雙邊磋商的請(qing)求。

  In this case, notification of the measures taken to the Committee on Safeguards and a request for bilateral consultations shall be effected immediately thereafter.

  臨時措施的期限(xian)不(bu)得超過200天,在此(ci)期間,應(ying)符合第(di)1款(kuan)、第(di)2款(kuan)和第(di)5款(kuan)的有關要求(qiu)。

  The duration of the provisional measure shall not exceed 200 days during which the pertinent requirements of paragraphs 1, 2 and 5 shall be met.

  任何臨時措施的期限均應(ying)計(ji)入第(di)6款下(xia)規定的期限。

  The duration of any provisional measure shall be counted toward the period provided for under paragraph 6.

  8.如一WTO成(cheng)員認(ren)為根據第(di)2款(kuan)(kuan)(kuan)、第(di)3款(kuan)(kuan)(kuan)或第(di)7款(kuan)(kuan)(kuan)采取的行動造成(cheng)或威(wei)脅造成(cheng)進入其市場的重(zhong)大貿易(yi)轉(zhuan)移,則該(gai)成(cheng)員可請求與中國和/或有關WTO成(cheng)員進行磋商。

  8. If a WTO Member considers that an action taken under paragraphs 2, 3 or 7 causes or threatens to cause significant diversions of trade into its market, it may request consultations with China and/or the WTO Member concerned.

  此類磋商應在向保障(zhang)措(cuo)施(shi)委員會作出通知后30天(tian)內舉行。

  Such consultations shall be held within 30 days after the request is notified to the Committee on Safeguards.

  如(ru)此類磋(cuo)商(shang)未(wei)能在作出通知后60天內使中國(guo)與一個(ge)或(huo)多(duo)個(ge)有(you)關(guan)WTO成員達成協議,則請求進行磋(cuo)商(shang)的(de)WTO成員在防止(zhi)或(huo)補救此類貿易轉(zhuan)移所必(bi)需的(de)限度內,有(you)權(quan)針對該產品撤銷(xiao)減讓或(huo)限制自中國(guo)的(de)進口(kou)。此種行動應立即通知保障措施(shi)委員會(hui)。

  If such consultations fail to lead to an agreement between China and the WTO Member or Members concerned within 60 days after the notification, the requesting WTO Member shall be free, in respect of such product, to withdraw concessions accorded to or otherwise limit imports from China, to the extent necessary to prevent or remedy such diversions. Such action shall be notified immediately to the Committee on Safeguards.

  9.本條的(de)適(shi)用應(ying)在加入之(zhi)日(ri)后12年終止。

  9. Application of this Section shall be terminated 12 years after the date of accession.

  第17條WTO成(cheng)員的保留  17. Reservations by WTO Members

  WTO成員(yuan)以與《WTO協(xie)定》不(bu)一(yi)致的方式針對自中國進口的產品維持(chi)的所有禁止、數量限制和其他措施列在(zai)附件(jian)7中。

  All prohibitions, quantitative restrictions and other measures maintained by WTO Members against imports from China in a manner inconsistent with the WTO Agreement are listed in Annex 7.

  所有(you)此(ci)類(lei)禁(jin)止、數(shu)量限制和(he)其他措(cuo)施應依照該(gai)附件(jian)所列(lie)共(gong)同議(yi)定的條(tiao)件(jian)和(he)時(shi)間表逐步取消(xiao)或(huo)加以(yi)處(chu)理。

  All such prohibitions, quantitative restrictions and other measures shall be phased out or dealt with in accordance with mutually agreed terms and timetables as specified in the said Annex.

  第18條過渡性審議機制  18. Transitional Review Mechanism

  1.所獲授(shou)權涵(han)蓋中國在(zai)《WTO協(xie)定(ding)》或(huo)本議定(ding)書(shu)項下(xia)承諾的WTO下(xia)屬機(ji)構[1],應(ying)在(zai)加入后1年(nian)內,并依照(zhao)以下(xia)第4款,在(zai)符(fu)合其授(shou)權的情況(kuang)下(xia),審(shen)議中國實施《WTO協(xie)定(ding)》和本議定(ding)書(shu)相關規定(ding)的情況(kuang)。

  1. Those subsidiary bodies[1] of the WTO which have a mandate covering China's commitments under the WTO Agreement or this Protocol shall, within one year after accession and in accordance with paragraph 4 below, review, as appropriate to their mandate, the implementation by China of the WTO Agreement and of the related provisions of this Protocol.

  中國應(ying)在審議前向每(mei)一下(xia)屬機構提供相(xiang)關信(xin)息,包括(kuo)附件(jian)1A所列信(xin)息。

  China shall provide relevant information, including information specified in Annex 1A, to each subsidiary body in advance of the review.

  中國(guo)也(ye)可在具有相關授權的(de)下屬機構(gou)中提(ti)出與第17條下任何保留或其他WTO成員在本議定書(shu)中所作(zuo)任何其他具體承(cheng)諾有關的(de)問題。

  China can also raise issues relating to any reservations under Section 17 or to any other specific commitments made by other Members in this Protocol, in those subsidiary bodies which have a relevant mandate.

  每一下屬(shu)機(ji)構應迅(xun)速向根據《WTO協定》第(di)4條第(di)5款設立的有關理(li)事會(hui)報(bao)告審議結果(如適用),有關理(li)事會(hui)應隨后迅(xun)速向總理(li)事會(hui)報(bao)告。

  Each subsidiary body shall report the results of such review promptly to the relevant Council established by paragraph 5 of Article IV of the WTO Agreement, if applicable, which shall in turn report promptly to the General Council.

  2.總理事會應在加入后1年內,依照以(yi)下(xia)第(di)4款,審(shen)議中國實施《WTO協定(ding)》和(he)本議定(ding)書條(tiao)款的(de)情況(kuang)。

  2. The General Council shall, within one year after accession, and in accordance with paragraph 4 below, review the implementation by China of the WTO Agreement and the provisions of this Protocol.

  總理事會應(ying)依(yi)照附(fu)件1B所列框架,并按照根據第(di)1款(kuan)進(jin)行的任何審議(yi)的結(jie)果,進(jin)行此項審議(yi)。

  The General Council shall conduct such review in accordance with the framework set out in Annex 1B and in the light of the results of any reviews held pursuant to paragraph 1.

  中國也可提(ti)出與第17條下任何保(bao)留或其(qi)(qi)他WTO成(cheng)員在本議定書(shu)中所作任何其(qi)(qi)他具(ju)體承(cheng)諾有關的問(wen)題。總理事會可在這些(xie)方(fang)面向中國或其(qi)(qi)他成(cheng)員提(ti)出建議。

  China also can raise issues relating to any reservations under Section 17 or to any other specific commitments made by other Members in this Protocol. The General Council may make recommendations to China and to other Members in these respects.

  3.根據本(ben)條(tiao)審議問題不(bu)得損害(hai)包括中(zhong)國在(zai)內的任(ren)何(he)WTO成員在(zai)《WTO協定(ding)》或(huo)任(ren)何(he)諸(zhu)邊(bian)貿易協定(ding)項(xiang)下的權利和(he)義務,并不(bu)得排除或(huo)構成要(yao)求磋商或(huo)援用《WTO協定(ding)》或(huo)本(ben)議定(ding)書中(zhong)其(qi)他規(gui)定(ding)的先(xian)決條(tiao)件。

  3. Consideration of issues pursuant to this Section shall be without prejudice to the rights and obligations of any Member, including China, under the WTO Agreement or any Plurilateral Trade Agreement, and shall not preclude or be a precondition to recourse to consultation or other provisions of the WTO Agreement or this Protocol.

  4.第1款(kuan)和(he)第2款(kuan)規定的(de)審議(yi)將(jiang)在(zai)(zai)加入(ru)后8年(nian)內每年(nian)進(jin)行(xing)(xing)。此后,將(jiang)在(zai)(zai)第10年(nian)或總理事會(hui)決定的(de)較(jiao)早日(ri)期進(jin)行(xing)(xing)最終審議(yi)。

4. The review provided for in paragraphs 1 and 2 will take place after accession in each year for eight years. Thereafter there will be a final review in year 10 or at an earlier date decided by the General Council.

 

  第二部分減讓表(biao)  Part II - Schedules

  1.本(ben)議定書所(suo)附減讓表(biao)應成為(wei)與中國有(you)關的(de)、GATT1994所(suo)附減讓和承(cheng)諾(nuo)(nuo)表(biao)及GATS所(suo)附具體承(cheng)諾(nuo)(nuo)表(biao)。

  1. The Schedules annexed to this Protocol shall become the Schedule of Concessions and Commitments annexed to the GATT 1994 and the Schedule of Specific Commitments annexed to the GATS relating to China.

  減讓(rang)表(biao)中所列減讓(rang)和承諾的實施期(qi)應按有(you)關減讓(rang)表(biao)相關部分列明的時間(jian)執行。

  The staging of concessions and commitments listed in the Schedules shall be implemented as specified in the relevant parts of the relevant Schedules.

  2.就(jiu)GATT1994第(di)2條第(di)6款(a)項(xiang)所(suo)指的該協定日(ri)期(qi)而(er)言,本議(yi)定書所(suo)附減讓和承諾表的適用日(ri)期(qi)應為加入之日(ri)。

  2. For the purpose of the reference in paragraph 6(a) of Article II of the GATT 1994 to the date of that Agreement, the applicable date in respect of the Schedules of Concessions and Commitments annexed to this Protocol shall be the date of accession.

  第三(san)部分最后(hou)條款  Part III - Final Provisions

  1.本議定(ding)書(shu)應開放供中(zhong)國在2002年1月1日(ri)前(qian)以簽字或其他方(fang)式接受(shou)。

  1. This Protocol shall be open for acceptance, by signature or otherwise, by China until 1 January 2002.

  2.本議定書應在接(jie)受之日后第30天生效。

  2. This Protocol shall enter into force on the thirtieth day following the day of its acceptance.

  3.本(ben)(ben)(ben)議定(ding)書(shu)(shu)應交存WTO總(zong)干事(shi)(shi)。總(zong)干事(shi)(shi)應根據本(ben)(ben)(ben)議定(ding)書(shu)(shu)第三部分第1款的(de)規定(ding),迅速向(xiang)每一WTO成員和(he)中(zhong)(zhong)國提供一份本(ben)(ben)(ben)議定(ding)書(shu)(shu)經核證無誤的(de)副(fu)本(ben)(ben)(ben)和(he)中(zhong)(zhong)國接受(shou)本(ben)(ben)(ben)議定(ding)書(shu)(shu)通知的(de)副(fu)本(ben)(ben)(ben)。

  3. This Protocol shall be deposited with the Director-General of the WTO. The Director-General shall promptly furnish a certified copy of this Protocol and a notification of acceptance by China thereof, pursuant to paragraph 1 of Part III of this Protocol, to each WTO Member and to China.

  4.本議定書(shu)應依照《聯合國憲章》第102條的規(gui)定予(yu)以登記。

  4. This Protocol shall be registered in accordance with the provisions of Article 102 of the Charter of the United Nations.

  2001年(nian)11月10日訂于多(duo)哈,正本一(yi)份(fen)用英文(wen)(wen)、法文(wen)(wen)和(he)西班牙(ya)文(wen)(wen)寫成(cheng),三種(zhong)文(wen)(wen)本具(ju)有同等效力,除非所附(fu)減(jian)讓表(biao)中規定該減(jian)讓表(biao)只以(yi)以(yi)上文(wen)(wen)字中的(de)一(yi)種(zhong)或多(duo)種(zhong)為準。

  Done at Doha this tenth day of November two thousand and one, in a single copy, in the English, French and Spanish languages, each text being authentic, except that a Schedule annexed hereto may specify that it is authentic in only one or more of these languages.

  China is requested to provide information on the following in accordance with Article 18.1 of the Protocol of Accession. The requested information should be provided annually, except in those cases where China and the Members agree that it is no longer required for the review.

  The Rules of Procedure of the WTO General Council shall apply unless specified otherwise. China shall submit any information and the documentation relating to the review no later than 30 days prior to the date of the review.
