Having regard to paragraph 2 of Article XII and paragraph 1 of Article IX of the Marrakesh Agreement Establishing the World Trade Organization, and the Decision-Making Procedures under Articles IX and XII of the Marrakesh Agreement Establishing the World Trade Organization agreed by the General Council (WT/L/93),

Noting the results of the negotiations directed toward the establishment of the terms of accession of the People's Republic of China to the Marrakesh Agreement Establishing the World Trade Organization and having prepared a Protocol on the Accession of the People's Republic of China,

中華人(ren)民共和國可根(gen)據本決(jue)定所(suo)附議(yi)定書中所(suo)列條款和條件(jian)加入《馬拉喀什建立世(shi)界(jie)貿易組織協定》。
The People's Republic of China may accede to the Marrakesh Agreement Establishing the World Trade Organization on the terms and conditions set out in the Protocol annexed to this decision.
PROTOCOL ON THE ACCESSION OF THE PEOPLE'S REPUBLIC OF CHINA
序言 Preamble
世(shi)界貿易組織(“WTO”),按(an)照WTO部長級會議根(gen)據《馬拉喀什建立世(shi)界貿易組織協定(ding)》(“《WTO協定(ding)》”)第12條所作出的批準,與中華人民(min)共和(he)國(guo)(“中國(guo)”),
The World Trade Organization ("WTO"), pursuant to the approval of the Ministerial Conference of the WTO accorded under Article XII of the Marrakesh Agreement Establishing the World Trade Organization ("WTO Agreement"), and the People's Republic of China ("China"),

第一部分(fen)總則 Part I - General Provisions
第(di)1條 總體(ti)情況(kuang) 1. General
1.自加(jia)入時起(qi),中國根據《WTO協定(ding)》第12條加(jia)入該協定(ding),并由此(ci)成為WTO成員。
1. Upon accession, China accedes to the WTO Agreement pursuant to Article XII of that Agreement and thereby becomes a Member of the WTO.
2.中國所加入的(de)《WTO協(xie)(xie)定》應為經在加入之日前(qian)已生效的(de)文件(jian)所更正(zheng)(zheng)、修(xiu)正(zheng)(zheng)或修(xiu)改的(de)《WTO協(xie)(xie)定》。
2. The WTO Agreement to which China accedes shall be the WTO Agreement as rectified, amended or otherwise modified by such legal instruments as may have entered into force before the date of accession.
本議(yi)定(ding)(ding)書,包括工作(zuo)組報告書第342段所指(zhi)的(de)承諾,應(ying)成(cheng)為《WTO協(xie)定(ding)(ding)》的(de)組成(cheng)部分。
This Protocol, which shall include the commitments referred to in paragraph 342 of the Working Party Report, shall be an integral part of the WTO Agreement.
3.除(chu)本議定(ding)(ding)書另有規(gui)定(ding)(ding)外(wai),中(zhong)(zhong)國(guo)應履(lv)(lv)行《WTO協(xie)定(ding)(ding)》所附(fu)各(ge)多邊貿易協(xie)定(ding)(ding)中(zhong)(zhong)的(de)、應在自該協(xie)定(ding)(ding)生效之(zhi)日起開始的(de)一(yi)段時(shi)間內(nei)履(lv)(lv)行的(de)義務,如同中(zhong)(zhong)國(guo)在該協(xie)定(ding)(ding)生效之(zhi)日已接(jie)受該協(xie)定(ding)(ding)。
3. Except as otherwise provided for in this Protocol, those obligations in the Multilateral Trade Agreements annexed to the WTO Agreement that are to be implemented over a period of time starting with entry into force of that Agreement shall be implemented by China as if it had accepted that Agreement on the date of its entry into force.
4.中(zhong)國可維(wei)持與《服務(wu)貿易(yi)總協定(ding)(ding)》(“GATS”)第2條第1款規定(ding)(ding)不(bu)一致的措施,只要(yao)此措施已記錄在本(ben)議定(ding)(ding)書所附《第2條豁(huo)(huo)免清單》中(zhong),并符合GATS《關于第2條豁(huo)(huo)免的附件(jian)》中(zhong)的條件(jian)。
4. China may maintain a measure inconsistent with paragraph 1of Article II of the General Agreement on Trade in Services ("GATS") provided that such a measure is recorded in the List of Article II Exemptions annexed to this Protocol and meets the conditions of the Annex to the GATS on Article II Exemptions.
第2條貿易制(zhi)度的實(shi)施 2. Administration of the Trade Regime
(A)統一實施 (A) Uniform Administration
1.《WTO協定(ding)》和本議定(ding)書的規定(ding)應適用于中國(guo)的全部(bu)關稅(shui)(shui)領土,包括(kuo)邊境貿易地區、民族自(zi)治地方、經(jing)濟特區、沿海開放城市、經(jing)濟技術開發(fa)區以及其他在關稅(shui)(shui)、國(guo)內稅(shui)(shui)和方面已建立(li)特殊制度(du)的地區(統(tong)稱為“特殊經(jing)濟區”)。
1. The provisions of the WTO Agreement and this Protocol shall apply to the entire customs territory of China, including border trade regions and minority autonomous areas, Special Economic Zones, open coastal cities, economic and technical development zones and other areas where special regimes for tariffs, taxes and regulations are established (collectively referred to as "special economic areas").
2.中國應(ying)以統一(yi)、公正(zheng)和(he)合理(li)的(de)(de)方(fang)式適用(yong)和(he)實施(shi)中央政(zheng)府有關或(huo)(huo)影(ying)響貨物貿易、服務貿易、與貿易有關的(de)(de)知識產權(“TRIPS”)或(huo)(huo)外(wai)匯管制的(de)(de)所有法(fa)律、法(fa)規及(ji)其(qi)他(ta)措(cuo)施(shi)以及(ji)地方(fang)各級政(zheng)府發布或(huo)(huo)適用(yong)的(de)(de)地方(fang)性法(fa)規、規章(zhang)及(ji)其(qi)他(ta)措(cuo)施(shi)(統稱為“法(fa)律、法(fa)規及(ji)其(qi)他(ta)措(cuo)施(shi)”)。
2. China shall apply and administer in a uniform, impartial and reasonable manner all its laws, regulations and other measures of the central government as well as local regulations, rules and other measures issued or applied at the sub-national level (collectively referred to as "laws, regulations and other measures") pertaining to or affecting trade in goods, services, trade-related aspects of intellectual property rights ("TRIPS") or the control of foreign exchange.
3.中(zhong)國地方各級政府的(de)地方性法規、規章及其他措(cuo)施(shi)應符合在(zai)《WTO協定》和本議定書中(zhong)所承擔(dan)的(de)義(yi)務。
3. China's local regulations, rules and other measures of local governments at the sub-national level shall conform to the obligations undertaken in the WTO Agreement and this Protocol.
4.中國(guo)應建立一(yi)種機(ji)制(zhi),使(shi)個人和(he)企業可據以提(ti)請(qing)國(guo)家主管機(ji)關(guan)注(zhu)意貿易制(zhi)度未統一(yi)適用的情況。
4. China shall establish a mechanism under which individuals and enterprises can bring to the attention of the national authorities cases of non-uniform application of the trade regime.
(B)特殊經濟區 (B) Special Economic Areas
1.中國應(ying)將所有與其特殊經濟區有關的法律、法規及其他(ta)措(cuo)施通知WTO,列明這些(xie)地(di)區的名稱,并指明界定這些(xie)地(di)區的地(di)理界線(xian)。
1. China shall notify to the WTO all the relevant laws, regulations and other measures relating to its special economic areas, listing these areas by name and indicating the geographic boundaries that define them.
中國應迅速,且無論如何應在60天內,將特殊經濟區的任(ren)何增加或改(gai)變通知WTO,包(bao)括與此(ci)有關(guan)的法律、法規及其他措施(shi)。
China shall notify the WTO promptly, but in any case within 60 days, of any additions or modifications to its special economic areas, including notification of the laws, regulations and other measures relating thereto.

2. China shall apply to imported products, including physically incorporated components, introduced into the other parts of China's customs territory from the special economic areas, all taxes, charges and measures affecting imports, including import restrictions and customs and tariff charges, that are normally applied to imports into the other parts of China's customs territory.
3.除本議定書另有(you)規定外,在對此類特殊經濟區內的企業提供(gong)優惠(hui)安排(pai)時(shi),WTO關于非歧視和國民待遇的規定應(ying)得到全(quan)面遵守(shou)。
3. Except as otherwise provided for in this Protocol, in providing preferential arrangements for enterprises within such special economic areas, WTO provisions on non-discrimination and national treatment shall be fully observed.
(C)透(tou)明(ming)度 (C) Transparency
1.中國承諾只執行已公(gong)布的(de)、且(qie)其他WTO成員、個人(ren)和(he)企業可容易獲(huo)得的(de)有(you)關或影響貨物貿(mao)易、服(fu)務貿(mao)易、TRIPS或外匯管(guan)制(zhi)的(de)法(fa)律、法(fa)規及其他措施。
1. China undertakes that only those laws, regulations and other measures pertaining to or affecting trade in goods, services, TRIPS or the control of foreign exchange that are published and readily available to other WTO Members, individuals and enterprises, shall be enforced.
此外,在所(suo)有有關或(huo)(huo)影響(xiang)貨物貿(mao)易、服務貿(mao)易、TRIPS或(huo)(huo)外匯管制(zhi)的法(fa)律(lv)、法(fa)規及其他(ta)措(cuo)施(shi)實施(shi)或(huo)(huo)執行前(qian),應(ying)請求,中國應(ying)使WTO成員可(ke)獲得此類(lei)措(cuo)施(shi)。
In addition, China shall make available to WTO Members, upon request, all laws, regulations and other measures pertaining to or affecting trade in goods, services, TRIPS or the control of foreign exchange before such measures are implemented or enforced.
在(zai)緊急(ji)情況下(xia),應使(shi)法律(lv)、法規及其他措施(shi)(shi)最遲在(zai)實施(shi)(shi)或執行之時(shi)可獲得。
In emergency situations, laws, regulations and other measures shall be made available at the latest when they are implemented or enforced.
2.中(zhong)國應(ying)設(she)立(li)或(huo)指定一官方刊(kan)物,用于公(gong)布所有(you)有(you)關(guan)或(huo)影響貨物貿(mao)易、服務貿(mao)易、TRIPS或(huo)外匯管制的法律、法規(gui)及其(qi)他(ta)措(cuo)(cuo)施(shi)(shi),并(bing)且在其(qi)法律、法規(gui)或(huo)其(qi)他(ta)措(cuo)(cuo)施(shi)(shi)在該(gai)刊(kan)物上公(gong)布之(zhi)(zhi)后,應(ying)在此類措(cuo)(cuo)施(shi)(shi)實施(shi)(shi)之(zhi)(zhi)前提(ti)供一段(duan)可向有(you)關(guan)主管機關(guan)提(ti)出(chu)意見的合理時(shi)間,
2. China shall establish or designate an official journal dedicated to the publication of all laws, regulations and other measures pertaining to or affecting trade in goods, services, TRIPS or the control of foreign exchange and, after publication of its laws, regulations or other measures in such journal, shall provide a reasonable period for comment to the appropriate authorities before such measures are implemented,
但(dan)涉及(ji)(ji)國家安全(quan)的法律、法規及(ji)(ji)其(qi)他措施、確定外匯匯率或(huo)貨(huo)幣政策的特(te)定措施以及(ji)(ji)一旦公布則會妨礙法律實施的其(qi)他措施除外。
except for those laws, regulations and other measures involving national security, specific measures setting foreign exchange rates or monetary policy and other measures the publication of which would impede law enforcement.
中國應(ying)定期(qi)出版該刊(kan)物(wu),并使個人(ren)和企(qi)業(ye)可容易獲得該刊(kan)物(wu)各期(qi)。
China shall publish this journal on a regular basis and make copies of all issues of this journal readily available to individuals and enterprises.
3.中國應(ying)設立或指定一(yi)咨詢(xun)點,應(ying)任何個人、企業或WTO成員的(de)請求,在咨詢(xun)點可獲得根據本議定書(shu)第(di)2條(C)節第(di)1款要求予以公(gong)布的(de)措施有關(guan)的(de)所(suo)有信息。
3. China shall establish or designate an enquiry point where, upon request of any individual, enterprise or WTO Member all information relating to the measures required to be published under paragraph 2(C)1 of this Protocol may be obtained.
對此(ci)類提(ti)供信息請求的答復一般應在(zai)收到請求后30天內作出。
Replies to requests for information shall generally be provided within 30 days after receipt of a request.
在例外情(qing)況下,可在收到請求后45天內作出答復。
In exceptional cases, replies may be provided within 45 days after receipt of a request.
延遲的通(tong)知及其原因應以書面形式(shi)向(xiang)有關當事人(ren)提供。
Notice of the delay and the reasons therefor shall be provided in writing to the interested party.
向WTO成員作出的答(da)復應全(quan)面(mian),并應代表中國政府的權威觀點。
Replies to WTO Members shall be complete and shall represent the authoritative view of the Chinese government.
應向(xiang)個(ge)人和企業(ye)提供準確和可靠的信息。
Accurate and reliable information shall be provided to individuals and enterprises.
(D)司(si)法審查 (D) Judicial Review
1.中(zhong)國應設(she)立或指(zhi)定(ding)并維(wei)持審查庭(ting)、聯(lian)絡(luo)點和(he)程序,以便迅(xun)速審查所有(you)與《1994年關(guan)稅與貿易總協(xie)定(ding)》(“GATT1994”)第10條第1款、GATS第6條和(he)《TRIPS協(xie)定(ding)》相關(guan)規(gui)定(ding)所指(zhi)的(de)(de)(de)(de)法(fa)律、法(fa)規(gui)、普遍適用的(de)(de)(de)(de)司法(fa)決定(ding)和(he)行政決定(ding)的(de)(de)(de)(de)實施有(you)關(guan)的(de)(de)(de)(de)所有(you)行政行為。
1. China shall establish, or designate, and maintain tribunals, contact points and procedures for the prompt review of all administrative actions relating to the implementation of laws, regulations, judicial decisions and administrative rulings of general application referred to in Article X:1 of the GATT 1994, Article VI of the GATS and the relevant provisions of the TRIPS Agreement.
此(ci)類審查庭應(ying)是公(gong)正的,并(bing)獨立于(yu)被(bei)授權進(jin)行(xing)行(xing)政執行(xing)的機(ji)關,且不應(ying)對審查事(shi)項的結果有任何實質利害(hai)關系。
Such tribunals shall be impartial and independent of the agency entrusted with administrative enforcement and shall not have any substantial interest in the outcome of the matter.
2.審(shen)(shen)查程序應包括給予受須經審(shen)(shen)查的(de)任何行(xing)政行(xing)為影(ying)響的(de)個人或(huo)企業進行(xing)上訴(su)的(de)機會,且(qie)不因(yin)上訴(su)而受到處罰。
2. Review procedures shall include the opportunity for appeal, without penalty, by individuals or enterprises affected by any administrative action subject to review.
如初始上訴權需向(xiang)行(xing)政機關提(ti)(ti)出(chu),則在(zai)所有情況下應有選擇(ze)向(xiang)司法機關對決定提(ti)(ti)出(chu)上訴的機會。
If the initial right of appeal is to an administrative body, there shall in all cases be the opportunity to choose to appeal the decision to a judicial body.
關(guan)于上訴的決定應通知上訴人,作(zuo)出該(gai)決定的理由應以(yi)書面形式提供。
Notice of the decision on appeal shall be given to the appellant and the reasons for such decision shall be provided in writing.
上訴人(ren)還應被告知(zhi)可進一步(bu)上訴的任何權利。
The appellant shall also be informed of any right to further appeal.
第3條(tiao)非歧視 3. Non-discrimination
除本議定書另(ling)有規定外,在下列方面給(gei)予(yu)外國個(ge)人、企業和外商投資(zi)企業的(de)待遇(yu)不得低(di)于給(gei)予(yu)其他個(ge)人和企業的(de)待遇(yu):
Except as otherwise provided for in this Protocol, foreign individuals and enterprises and foreign-funded enterprises shall be accorded treatment no less favourable than that accorded to other individuals and enterprises in respect of:
(a)生產所需投入物、貨物和(he)服務的采購,及其貨物據(ju)以在國內市場或(huo)供出口而(er)生產、營銷或(huo)銷售的條件(jian);及
(a) the procurement of inputs and goods and services necessary for production and the conditions under which their goods are produced, marketed or sold, in the domestic market and for export; and
(b)國(guo)家和(he)地(di)方各級主(zhu)管機關(guan)以及公有(you)或國(guo)有(you)企業在包括(kuo)運(yun)輸、能(neng)源、基礎電信、其(qi)他生產設施和(he)要素等領域所供應的貨物和(he)服(fu)務的價格和(he)可用性。
(b) the prices and availability of goods and services supplied by national and sub-national authorities and public or state enterprises, in areas including transportation, energy, basic telecommunications, other utilities and factors of production.
第4條特殊(shu)貿(mao)易安排(pai) 4. Special Trade Arrangements
自加(jia)入時起,中國應取消與(yu)(yu)第三國和單獨關稅區之間的、與(yu)(yu)《WTO協定(ding)》不符的所有特殊貿易安排,包括易貨(huo)貿易安排,或(huo)使其符合(he)《WTO協定(ding)》。
Upon accession, China shall eliminate or bring into conformity with the WTO Agreement all special trade arrangements, including barter trade arrangements, with third countries and separate customs territories, which are not in conformity with the WTO Agreement.
第5條貿易權(quan) 5. Right to Trade
1.在(zai)(zai)(zai)不損(sun)害中國以(yi)與符合《WTO協定》的(de)(de)方式管理貿易(yi)的(de)(de)權(quan)利的(de)(de)情況下,中國應逐步(bu)放寬貿易(yi)權(quan)的(de)(de)獲(huo)得(de)及其范圍,以(yi)便在(zai)(zai)(zai)加入后3年(nian)內(nei),使所有在(zai)(zai)(zai)中國的(de)(de)企業均有權(quan)在(zai)(zai)(zai)中國的(de)(de)全部(bu)關稅領土(tu)內(nei)從(cong)事所有貨物(wu)的(de)(de)貿易(yi),但(dan)附件(jian)2A所列依照本議定書繼續實行國營貿易(yi)的(de)(de)貨物(wu)除外。
1. Without prejudice to China's right to regulate trade in a manner consistent with the WTO Agreement, China shall progressively liberalize the availability and scope of the right to trade, so that, within three years after accession, all enterprises in China shall have the right to trade in all goods throughout the customs territory of China, except for those goods listed in Annex 2A which continue to be subject to state trading in accordance with this Protocol.
此(ci)種貿易權(quan)應(ying)為進口或出口貨物的權(quan)利(li)。
Such right to trade shall be the right to import and export goods.
對(dui)于所有此類貨物,均應根據GATT1994第3條,特別是其中第4款的規定,在(zai)國內銷售、許諾銷售、購(gou)買(mai)、運(yun)輸、分(fen)銷或使用(yong)方面,包括直接(jie)接(jie)觸(chu)最終用(yong)戶方面,給(gei)予(yu)國民待(dai)遇。
All such goods shall be accorded national treatment under Article III of the GATT 1994, especially paragraph 4 thereof, in respect of their internal sale, offering for sale, purchase, transportation, distribution or use, including their direct access to end-users.
對于附(fu)件2B所列貨物(wu),中國應根據該附(fu)件中所列時間表(biao)逐步取消在給予貿易權方面(mian)的限制。
For those goods listed in Annex 2B, China shall phase out limitation on the grant of trading rights pursuant to the schedule in that Annex.
中(zhong)國應在過渡期(qi)內完成執(zhi)行這(zhe)些規(gui)定(ding)所必需(xu)的立法程序。
China shall complete all necessary legislative procedures to implement these provisions during the transition period.
2.除(chu)本議定書(shu)另有(you)規定外(wai),對于所有(you)外(wai)國(guo)個人(ren)和企(qi)(qi)業,包括未在(zai)中國(guo)投(tou)資或注冊(ce)的(de)(de)外(wai)國(guo)個人(ren)和企(qi)(qi)業,在(zai)貿易(yi)權(quan)方面應給(gei)予其不低于給(gei)予在(zai)中國(guo)的(de)(de)企(qi)(qi)業的(de)(de)待遇(yu)。
2. Except as otherwise provided for in this Protocol, all foreign individuals and enterprises, including those not invested or registered in China, shall be accorded treatment no less favourable than that accorded to enterprises in China with respect to the right to trade.
第6條國營(ying)貿易 6. State Trading
1.中國(guo)應(ying)保(bao)證(zheng)國(guo)營(ying)貿(mao)易企(qi)業的進口購買(mai)程序完(wan)全透明(ming),并符(fu)合《WTO協(xie)定》,且應(ying)避(bi)免采(cai)取任何措施對國(guo)營(ying)貿(mao)易企(qi)業購買(mai)或(huo)銷(xiao)售貨物的數量、價值(zhi)或(huo)原產(chan)國(guo)施加影響(xiang)或(huo)指導,但依照《WTO協(xie)定》進行的除外(wai)。
1. China shall ensure that import purchasing procedures of state trading enterprises are fully transparent, and in compliance with the WTO Agreement, and shall refrain from taking any measure to influence or direct state trading enterprises as to the quantity, value, or country of origin of goods purchased or sold, except in accordance with the WTO Agreement.
2.作為根據GATT1994和《關于解釋1994年(nian)關稅(shui)與貿(mao)易(yi)總(zong)協定第17條的(de)諒解》所作通知的(de)一部分,中國(guo)(guo)還應提供(gong)有關其國(guo)(guo)營貿(mao)易(yi)企業出口貨物定價機制(zhi)的(de)全部信息。
2. As part of China's notification under the GATT 1994 and the Understanding on the Interpretation of Article XVII of the GATT 1994, China shall also provide full information on the pricing mechanisms of its state trading enterprises for exported goods.

1. China shall implement the schedule for phased elimination of the measures contained in Annex 3. During the periods specified in Annex 3, the protection afforded by the measures listed in that Annex shall not be increased or expanded in size, scope or duration, nor shall any new measures be applied, unless in conformity with the provisions of the WTO Agreement.

2. In implementing the provisions of Articles III and XI of the GATT 1994 and the Agreement on Agriculture, China shall eliminate and shall not introduce, re-introduce or apply non-tariff measures that cannot be justified under the provisions of the WTO Agreement.

For all non-tariff measures, whether or not referred to in Annex 3, that are applied after the date of accession, consistent with the WTO Agreement or this Protocol, China shall allocate and otherwise administer such measures in strict conformity with the provisions of the WTO Agreement, including GATT 1994 and Article XIII thereof, and the Agreement on Import Licensing Procedures, including notification requirements.

3. China shall, upon accession, comply with the TRIMs Agreement, without recourse to the provisions of Article 5 of the TRIMs Agreement.

China shall eliminate and cease to enforce trade and foreign exchange balancing requirements, local content and export or performance requirements made effective through laws, regulations or other measures. Moreover, China will not enforce provisions of contracts imposing such requirements.

Without prejudice to the relevant provisions of this Protocol, China shall ensure that the distribution of import licences, quotas, tariff?rate quotas, or any other means of approval for importation, the right of importation or investment by national and sub?national authorities, is not conditioned on:

whether competing domestic suppliers of such products exist; or performance requirements of any kind, such as local content, offsets, the transfer of technology, export performance or the conduct of research and development in China.

4. Import and export prohibitions and restrictions, and licensing requirements affecting imports and exports shall only be imposed and enforced by the national authorities or by sub-national authorities with authorization from the national authorities.

Such measures which are not imposed by the national authorities or by sub-national authorities with authorization from the national authorities, shall not be implemented or enforced.

1.在實施(shi)《WTO協(xie)定》和《進口許可(ke)程序(xu)協(xie)定》的規定時(shi),中國應采(cai)取以下措施(shi),以便遵守這(zhe)些協(xie)定:
1. In implementing the WTO Agreement and provisions of the Agreement on Import Licensing Procedures, China shall undertake the following measures to facilitate compliance with these agreements:

(a) China shall publish on a regular basis the following in the official journal referred to in paragraph 2(C)2 of this Protocol:

– by product, the list of all organizations, including those organizations delegated such authority by the national authorities, that are responsible for authorizing or approving imports or exports, whether through grant of licence or other approval;

Copies of these submissions in one or more official languages of the WTO shall be forwarded to the WTO for circulation to WTO Members and for submission to the Committee on Import Licensing within 75 days of each publication.

(b) China shall notify the WTO of all licensing and quota requirements remaining in effect after accession, listed separately by HS tariff line and with the quantities associated with the restriction, if any, and the justification for maintaining the restriction or its scheduled date of termination.

(c) China shall submit the notification of its import licensing procedures to the Committee on Import Licensing.
中國應每年向(xiang)進(jin)口(kou)(kou)許(xu)(xu)可程(cheng)序(xu)委員會報(bao)告其自(zi)動(dong)進(jin)口(kou)(kou)許(xu)(xu)可程(cheng)序(xu)的情(qing)況,說明產生這(zhe)些要求的情(qing)況,并證明繼續(xu)實行的需要。
China shall report annually to the Committee on Import Licensing on its automatic import licensing procedures, explaining the circumstances which give rise to these requirements and justifying the need for their continuation.

This report shall also provide the information listed in Article 3 of the Agreement on Import Licensing Procedures.

(d) China shall issue import licences for a minimum duration of validity of six months, except where exceptional circumstances make this impossible.

In such cases, China shall promptly notify the Committee on Import Licensing of the exceptional circumstances requiring the shorter period of licence validity.

2. Except as otherwise provided for in this Protocol, foreign individuals and enterprises and foreign-funded enterprises shall be accorded treatment no less favourable than that accorded to other individuals and enterprises in respect of the distribution of import and export licences and quotas.
第9條價格控制 9. Price Controls
1.在遵守以下第2款的(de)(de)(de)前提下,中國應(ying)允許每一部門(men)交易的(de)(de)(de)貨(huo)物(wu)和服(fu)務的(de)(de)(de)價格由(you)市場力量決定(ding),且應(ying)取消(xiao)對(dui)此類(lei)貨(huo)物(wu)和服(fu)務的(de)(de)(de)多(duo)重定(ding)價做法。
1. China shall, subject to paragraph 2 below, allow prices for traded goods and services in every sector to be determined by market forces, and multi-tier pricing practices for such goods and services shall be eliminated.

2. The goods and services listed in Annex 4 may be subject to price controls, consistent with the WTO Agreement, in particular Article III of the GATT 1994 and Annex 2, paragraphs 3 and 4 of the Agreement on Agriculture.

Except in exceptional circumstances, and subject to notification to the WTO, price controls shall not be extended to goods or services beyond those listed in Annex 4, and China shall make best efforts to reduce and eliminate these controls.
3.中(zhong)國應在官方刊物(wu)(wu)上公布實行國家定(ding)價的貨物(wu)(wu)和(he)服務的清單及其變更情(qing)況。
3. China shall publish in the official journal the list of goods and services subject to state pricing and changes thereto.
第10條(tiao)補貼 10. Subsidies
1.中國應通知WTO在(zai)其領土內給予或維持的(de)、屬《補貼(tie)與反(fan)補貼(tie)措施協定》(“《SCM協定》”)第1條(tiao)含義內的(de)、按具體(ti)產品劃分的(de)任何補貼(tie),包括《SCM協定》第3條(tiao)界(jie)定的(de)補貼(tie)。
1. China shall notify the WTO of any subsidy within the meaning of Article 1 of the Agreement on Subsidies and Countervailing Measures ("SCM Agreement"), granted or maintained in its territory, organized by specific product, including those subsidies defined in Article 3 of the SCM Agreement.
所(suo)提供的信息應(ying)盡可能具體,并(bing)遵循《SCM協定》第25條所(suo)提及的關于補貼問卷的要求。
The information provided should be as specific as possible, following the requirements of the questionnaire on subsidies as noted in Article 25 of the SCM Agreement.

For purposes of applying Articles 1.2 and 2 of the SCM Agreement, subsidies provided to state-owned enterprises will be viewed as specific if, inter alia, state?owned enterprises are the predominant recipients of such subsidies or state?owned enterprises receive disproportionately large amounts of such subsidies.

3. China shall eliminate all subsidy programmes falling within the scope of Article 3 of the SCM Agreement upon accession.
第11條 對進出口產品征收的稅費(fei)
11. Taxes and Charges Levied on Imports and Exports
1.中國應保證國家主管(guan)機關或(huo)(huo)地方各級主管(guan)機關實施或(huo)(huo)管(guan)理的海關規費(fei)或(huo)(huo)費(fei)用符合(he)GATT1994。
1. China shall ensure that customs fees or charges applied or administered by national or sub-national authorities, shall be in conformity with the GATT 1994.
2.中國(guo)(guo)應保證(zheng)國(guo)(guo)家主管(guan)機關或地方各級主管(guan)機關實施或管(guan)理的國(guo)(guo)內(nei)稅(shui)費,包括增值稅(shui),符合GATT1994。
2. China shall ensure that internal taxes and charges, including value-added taxes, applied or administered by national or sub-national authorities shall be in conformity with the GATT 1994.
3.中(zhong)國應取(qu)消適用于出口產品的(de)全(quan)部(bu)稅費,除(chu)非本議定(ding)(ding)書附件6中(zhong)有明確(que)規定(ding)(ding)或按照GATT1994第8條的(de)規定(ding)(ding)適用。
3. China shall eliminate all taxes and charges applied to exports unless specifically provided for in Annex 6 of this Protocol or applied in conformity with the provisions of Article VIII of the GATT 1994.

4. Foreign individuals and enterprises and foreign-funded enterprises shall, upon accession, be accorded treatment no less favourable than that accorded to other individuals and enterprises in respect of the provision of border tax adjustments.
第12條農業 12. Agriculture
1.中國應實(shi)施(shi)中國貨(huo)物貿易承(cheng)諾(nuo)和減(jian)讓表中包(bao)含的(de)(de)規定,以及本議定書(shu)具體(ti)規定的(de)(de)《農(nong)業協定》的(de)(de)條款。在這方面,中國不得對(dui)農(nong)產品維(wei)持或(huo)采取(qu)任何出口補貼。
1. China shall implement the provisions contained in China's Schedule of Concessions and Commitments on Goods and, as specifically provided in this Protocol, those of the Agreement on Agriculture. In this context, China shall not maintain or introduce any export subsidies on agricultural products.

2. China shall, under the Transitional Review Mechanism, notify fiscal and other transfers between or among state-owned enterprises in the agricultural sector (whether national or sub-national) and other enterprises that operate as state trading enterprises in the agricultural sector.
第13條技術性貿易壁(bi)壘 13. Technical Barriers to Trade
1.中國應(ying)在官方刊物上公布(bu)作為技術法規、標(biao)準(zhun)或(huo)合格評(ping)定程序依據的(de)所有正式(shi)的(de)或(huo)非正式(shi)的(de)標(biao)準(zhun)。
1. China shall publish in the official journal all criteria, whether formal or informal, that are the basis for a technical regulation, standard or conformity assessment procedure.
2.中國應(ying)自加(jia)入時起,使(shi)所有技術法(fa)規、標準和(he)合(he)(he)格評定(ding)程序符合(he)(he)《TBT協定(ding)》。
2. China shall, upon accession, bring into conformity with the TBT Agreement all technical regulations, standards and conformity assessment procedures.
3.中國對(dui)進(jin)口(kou)產品實施合格評定(ding)程序的目的應僅為確定(ding)其是否符合與本議(yi)定(ding)書(shu)和《WTO協定(ding)》規(gui)定(ding)相一致的技(ji)術法規(gui)和標準。
3. China shall apply conformity assessment procedures to imported products only to determine compliance with technical regulations and standards that are consistent with the provisions of this Protocol and the WTO Agreement.

Conformity assessment bodies will determine the conformity of imported products with commercial terms of contracts only if authorized by the parties to such contract.

China shall ensure that such inspection of products for compliance with the commercial terms of contracts does not affect customs clearance or the granting of import licences for such products.

4. (a) Upon accession, China shall ensure that the same technical regulations, standards and conformity assessment procedures are applied to both imported and domestic products.
為保證從(cong)現行(xing)體制的順利過渡(du),中國應保證自(zi)加(jia)入時起,所(suo)有(you)認證、安全許(xu)可(ke)(ke)和質量許(xu)可(ke)(ke)機構和部(bu)門(men)獲得既對(dui)(dui)(dui)進口產品又對(dui)(dui)(dui)國產品進行(xing)此類(lei)活動的授(shou)權;加(jia)入1年后,所(suo)有(you)合格評(ping)定機構和部(bu)門(men)獲得既對(dui)(dui)(dui)進口產品又對(dui)(dui)(dui)國產品進行(xing)合格評(ping)定的授(shou)權。
In order to ensure a smooth transition from the current system, China shall ensure that, upon accession, all certification, safety licensing, and quality licensing bodies and agencies are authorized to undertake these activities for both imported and domestic products, and that, one year after accession, all conformity assessment bodies and agencies are authorized to undertake conformity assessment for both imported and domestic products.

The choice of body or agency shall be at the discretion of the applicant.

For imported and domestic products, all bodies and agencies shall issue the same mark and charge the same fee. They shall also provide the same processing periods and complaint procedures.

Imported products shall not be subject to more than one conformity assessment.

China shall publish and make readily available to other WTO Members, individuals, and enterprises full information on the respective responsibilities of its conformity assessment bodies and agencies.

(b) No later than 18 months after accession, China shall assign the respective responsibilities of its conformity assessment bodies solely on the basis of the scope of work and type of product without any consideration of the origin of a product.
指(zhi)定給中(zhong)國(guo)各合格(ge)評(ping)定機構的相應職責(ze)將在(zai)加入后12個(ge)月(yue)通知(zhi)TBT委員會(hui)。
The respective responsibilities that will be assigned to China’s conformity assessment bodies will be notified to the TBT Committee 12 months after accession.
第14條衛生與(yu)植物衛生措施 14. Sanitary and Phytosanitary Measures
中國(guo)應(ying)在加入(ru)后30天內,向WTO通(tong)知其(qi)所有有關衛生(sheng)與植物衛生(sheng)措施的法(fa)律、法(fa)規及(ji)其(qi)他措施,包括產品(pin)范圍及(ji)相(xiang)關國(guo)際(ji)標準、指南(nan)和建(jian)議。
China shall notify to the WTO all laws, regulations and other measures relating to its sanitary and phytosanitary measures, including product coverage and relevant international standards, guidelines and recommendations, within 30 days after accession.

15. Price Comparability in Determining Subsidies and Dumping
GATT1994第6條、《關于(yu)實施1994年關稅(shui)與貿(mao)易總(zong)協(xie)(xie)定(ding)第6條的協(xie)(xie)定(ding)》(“《反(fan)傾銷(xiao)協(xie)(xie)定(ding)》”)以及(ji)《SCM協(xie)(xie)定(ding)》應適用(yong)于(yu)涉(she)及(ji)原產(chan)于(yu)中國的進(jin)口產(chan)品進(jin)入一WTO成員(yuan)的程(cheng)序,并應符合(he)下(xia)列規定(ding):
Article VI of the GATT 1994, the Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 ("Anti-Dumping Agreement") and the SCM Agreement shall apply in proceedings involving imports of Chinese origin into a WTO Member consistent with the following:
(a)在根(gen)據(ju)(ju)GATT1994第6條和《反傾銷(xiao)協定》確定價格可比性時,該WTO進口成員(yuan)應依據(ju)(ju)下列規則(ze),使(shi)用接受調查產業的(de)中(zhong)國(guo)(guo)價格或成本(ben),或者使(shi)用不(bu)依據(ju)(ju)與中(zhong)國(guo)(guo)國(guo)(guo)內(nei)價格或成本(ben)進行(xing)嚴格比較的(de)方法:
(a) In determining price comparability under Article VI of the GATT 1994 and the Anti?Dumping Agreement, the importing WTO Member shall use either Chinese prices or costs for the industry under investigation or a methodology that is not based on a strict comparison with domestic prices or costs in China based on the following rules:
(i)如(ru)受調(diao)查的生產者(zhe)能(neng)夠明(ming)確證明(ming),生產該同類產品的產業在(zai)制(zhi)造、生產和銷(xiao)售該產品方(fang)面(mian)具備市場經濟條件,則該WTO進(jin)口成(cheng)員在(zai)確定價(jia)格(ge)可(ke)比性時,應(ying)使用(yong)受調(diao)查產業的中(zhong)國(guo)價(jia)格(ge)或成(cheng)本(ben);
(i) If the producers under investigation can clearly show that market economy conditions prevail in the industry producing the like product with regard to the manufacture, production and sale of that product, the importing WTO Member shall use Chinese prices or costs for the industry under investigation in determining price comparability;
(ii)如受調查的生產(chan)(chan)者不(bu)能明確證明生產(chan)(chan)該同類(lei)產(chan)(chan)品的產(chan)(chan)業(ye)在制造(zao)、生產(chan)(chan)和銷售該產(chan)(chan)品方面具備市場經濟條件,則該WTO進口成員可使(shi)用不(bu)依(yi)據與中國(guo)國(guo)內價格(ge)或成本進行嚴格(ge)比較的方法。
(ii) The importing WTO Member may use a methodology that is not based on a strict comparison with domestic prices or costs in China if the producers under investigation cannot clearly show that market economy conditions prevail in the industry producing the like product with regard to manufacture, production and sale of that product.
(b)在根據(ju)《SCM協定》第二、三及(ji)五(wu)部(bu)分規定進行的程序中,在處理第14條(a)項(xiang)、(b)項(xiang)、(c)項(xiang)和(d)項(xiang)所述補貼時,應適用《SCM協定》的有關規定;
(b) In proceedings under Parts II, III and V of the SCM Agreement, when addressing subsidies described in Articles 14(a), 14(b), 14(c) and 14(d), relevant provisions of the SCM Agreement shall apply;
但是,如此種(zhong)適用(yong)遇(yu)有(you)特殊困難,則該WTO進口成(cheng)員可使用(yong)考慮到中國(guo)國(guo)內現有(you)情況和條件(jian)并非(fei)總能(neng)用(yong)作適當(dang)基準這一可能(neng)性的(de)確定和衡量(liang)補貼利益的(de)方法。
however, if there are special difficulties in that application, the importing WTO Member may then use methodologies for identifying and measuring the subsidy benefit which take into account the possibility that prevailing terms and conditions in China may not always be available as appropriate benchmarks.
在(zai)適用此(ci)類(lei)方(fang)法時,只要可行,該WTO進(jin)口(kou)成員在(zai)考慮使用中國以外的情況和條件(jian)之前,應對此(ci)類(lei)現有情況和條件(jian)進(jin)行調整(zheng)。
In applying such methodologies, where practicable, the importing WTO Member should adjust such prevailing terms and conditions before considering the use of terms and conditions prevailing outside China.
(c)該(gai)WTO進口成員應(ying)向反傾(qing)銷措(cuo)(cuo)施(shi)委(wei)(wei)員會通(tong)知依照(zhao)(a)項(xiang)使用的方法,并應(ying)向補貼(tie)與(yu)反補貼(tie)措(cuo)(cuo)施(shi)委(wei)(wei)員會通(tong)知依照(zhao)(b)項(xiang)使用的方法。
(c) The importing WTO Member shall notify methodologies used in accordance with subparagraph (a) to the Committee on Anti-Dumping Practices and shall notify methodologies used in accordance with subparagraph (b) to the Committee on Subsidies and Countervailing Measures.
(d)一(yi)旦中國根據(ju)該(gai)WTO進口成員的(de)國內法證實其是一(yi)個市場經濟體,則(a)項的(de)規定即(ji)應(ying)終(zhong)止,但截至加入之日,該(gai)WTO進口成員的(de)國內法中須包含有關市場經濟的(de)標準。
(d) Once China has established, under the national law of the importing WTO Member, that it is a market economy, the provisions of subparagraph (a) shall be terminated provided that the importing Member's national law contains market economy criteria as of the date of accession.
無論如何,(a)項(xiang)(ii)目的規定(ding)應(ying)在加入之日(ri)后15年終止。
In any event, the provisions of subparagraph (a)(ii) shall expire 15 years after the date of accession.
此外,如中國(guo)根據該(gai)WTO進(jin)口(kou)成員的國(guo)內法證(zheng)實一特定產業(ye)(ye)或(huo)部門(men)具備市場經濟條件(jian),則(a)項中的非市場經濟條款不得再對該(gai)產業(ye)(ye)或(huo)部門(men)適用。
In addition, should China establish, pursuant to the national law of the importing WTO Member, that market economy conditions prevail in a particular industry or sector, the non?market economy provisions of subparagraph (a) shall no longer apply to that industry or sector.
